WHAT ACTUALLY HAPPENS IN A MEDIATION CONFERENCE?

I will explain how the mediation process works to both sides, either together or separately. The parties will appear with their attorneys or pro se.

Each side will have the opportunity to explain their case and important issues that matter to them. At any time during the process, the conference can be split so that I will meet with each side separately. During this time, the parties will have the chance to discuss the issues with their attorneys and to reflect on the progress. The parties are urged with my help to come up with ideas and perspectives to work out the agreement.

Proposals for resolution will be raised and negotiated until each issue has been addressed. Often this process can take more than one session. I encourage parties to settle those issues that can be settled, and to commit to keeping the door open for further settlements. You will likely leave with a typed agreement resolving your case that you can live with.
